La La Vieのご利用に際しては、本利用規約をお読みください。

本規約は、La La Vie・Connecting Point LLCが提供するサイト上のコンテンツ、サービス、情報、および、La La Vie・Connecting Point LLCが発行するメールマガジンその他の電子メールによる情報の利用に適用されます。※La La Vieは運営国である米国の法令に準拠して運営されており、日本国以外のいかなる国や地域に関しても、当該国や地域の適用される法令に適合していることを保証するものではありません。ユーザーは、La La Vieへのアクセスおよび利用にあたり、その責任において、ユーザー自身に適用される国または地域の法令を遵守しなければならないものとします。

1. 「La La Vie」とは、La La Vie・Connecting Point LLCが提供するインターネット上のパートナー捜しのための登録・情報サイト（www.lala-vie.com）その関連サイト、および当該サイトに付随する電子メール配信その他のサポート支援サービスの総称をいいます。
2. 「ユーザー」とは、La La Vieのサーチ情報やLa La Vieに登録したメンバー、またはLa La Vie関連の全てのサービスの利用者の総称をいいます。
3. ユーザーは、自らの意思と責任のもと、La La Vieをご利用ください。また、利用に関わるすべての責任はユーザーが負うものとします。
4. La La Vieが提供するサービスは、利用者が本利用規約の内容すべてに承諾することを条件として提供されます。当サイトのサービスをご利用いただくことによっ て、ユーザーは本規約を承諾いただいたものとみなします。
5. 登録者・メンバーについて
   「登録者・メンバー」とは、La La Vieに登録し、La La Vie・Connecting Point LLCがこれを承認した方をいいます。登録者・メンバーは、登録の時点で本規約の内容を承認したものとみなします。
   登録者・メンバーは、La La Vieサイトの登録専用のページにおいて、メンバー登録の際に入力した情報やメールマガジン配信に関する情報を、いつでも確認・変更・追加・削除する事ができます。
   登録者・メンバーは、La La Vieへメールにて登録情報抹消リクエストを行う事ができます。登録者・メンバーは登録システムから登録情報の抹消ができる場合は、自ら情報削除をする事ができます。
   登録者・メンバーが自ら登録の抹消を行わない場合、または、抹消を希望しない場合であっても、メンバー登録後の3年後にメンバー登録が抹消される場合があります。
   La La Vie・Connecting Point LLCは、登録者・メンバーが本規約に違反したとLa La Vie・Connecting Point LLCが判断した場合は、登録者・メンバーに事前に通知することなく、ご紹介サービスの提供を一時中止、または除名することができます。

Privacy Policy

This is the website of www.lala-vie.com (the “Websites”).  We will not distribute personal information, including your name, email address, or any other information, to third parties.  We will only use your telephone number or email address for inquiries related to www.lala-vie.com.  We do not provide site visitors access to information from or about other site visitors or customers.  Maintaining your privacy is of the utmost importance to us.

Terms of Use

Set forth below are the terms and conditions governing Connecting Point LLC (“La La Vie, Pacific Match Global, La La Story” or the “Company”).  By registering with La La Vie, you agree to be bound by these Terms of Use (this “Agreement”), whether or not you use the services offered (the “Services”) of the Company.  If you do not wish to abide by this Agreement, please do not register and do not use any portion of this site. We reserve the right to change, update, modify, and/or revise these terms of use at any time at our sole discretion, without notice or liability.  Please check back often to review any updated terms.

Eligibility

The Website is not intended to be viewed, and the Services are not intended to be purchased or used, by minors or anyone under the age of eighteen.  By entering the Website or using the Services, you are agreeing that you are not under the age of eighteen.

Other Terms and Conditions

By using the Services of La La Vie, you are representing to the La La Vie that you have agreed not only to the terms and conditions stated here but the terms and conditions of any online dating site you are currently using or intend to use.  You should carefully read the privacy policies and other conditions of use on your online dating site of choice to ensure that using the Services of La La Vie is permitted by the terms and conditions of any online dating site that you are currently using or intend to use.

Billing and Refund Policy

All purchases made and Services contracted by you with La La Vie are final and no refunds or credits will be given to you for any reason if you cancel this Agreement or do not use or discontinue the Services before the end of the Agreement (except the aforementioned period before the work begins). In no event shall you be entitled to refunds or credits because of a curtailment of the Services for any reason, including but not limited to: meeting a partner through the Services, meeting a partner outside of the Services, dissatisfaction with the Services, or a “pause” or “break” from the Services of La La Vie . In other words, once the Services begin, no refunds or credits will be provided.

If you notify the La La Vie  in writing, in advance, that you wish to put your service on hold, the La La Vie  will allow you to do so for a period up to six months, with the Services resuming for the time remaining when you notify La La Vie  that you wish to resume the Services within that six-month period. Any such hold will expire after these six months. In addition, if you have not utilized previously paid for Services for a consecutive six-month period or more, with no prior hold notification to La La Vie and no communication with La La Vie in that time period, then those Services will be forfeited after those six months. Any unused Services will be forfeited without any refund or credit being provided to you.

As La La Vie has limited resources, all of those resources are dedicated to current clients, so by taking you on, La La Vie may have had to turn others away.

Interactions

You are solely responsible for your interactions, online or in person, with individuals identified for you by La La Vie.  By using the Services of La La Vie, you understand and agree that La La Vie does not in any way screen the members of any online dating sites.  La La Vie makes no representations or warranties as to the conduct of any person it has identified or will identify to you. In no event shall La La Vie be liable for any damages whatsoever, either direct, indirect, general, special, compensatory, consequential, punitive, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Services, including, without limitation, bodily injury, death, emotional distress, and/or other damages resulting from communications or interactions, online or in person, with any persons you meet through the Services offered by La La Vie.

Communications and Content

All email sent to any email addresses of the Website becomes the property of La La Vie.  The Website may provide links to the sites of affiliated companies and certain other businesses or materials.  La La Vie is not responsible for examining or evaluating and does not warrant the offerings of, any of these businesses or individuals or the content of the websites.  La La Vie does not assume any responsibility or liability for the actions, product, and content of these and any other third parties. Your use of such websites or materials is at your own risk and you should carefully review all privacy statements and other conditions of use.

You shall use the Website for lawful purposes only.  You shall not post or transmit via the Website any material which violates or infringes in any way upon the rights of others, which is false, unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, which encourages conduct that would constitute a criminal offense, gives rise to civil liability, or otherwise violates any law, or which, without the Website’s express written prior approval, contains advertising or any solicitation with respect to the Services.  Additionally, when interacting online or in person with anyone identified by the Website, you shall not violate or infringe in any way upon the rights of others, and you shall not engage in any behaviour which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable, which encourages conduct that would constitute a criminal offence, gives rise to civil liability, or otherwise violates any law.

Limitation of Liability

By using the Website, materials, or Services of La La Vie, you agree to release and hold harmless La La Vie and the employees, officers, directors, members, managers, shareholders, agents, representatives of La La Vie, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, any entity controlling, controlled by or under common control with La La Vie, any third-party providers or sources of information or data, and legal advisers from any and all losses, damages, rights, claims, and actions of any kind arising from or related to the Website, materials, or Services, including but not limited to:

(a) telephone, electronic, hardware or software, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (b) failed, incomplete, garbled, or delayed computer transmissions; (c) any condition caused by events beyond the control of La La Vie that may cause the Website or related Services to be disrupted or corrupted; (d) any injuries, losses or damages of any kind arising in connection with or as a result of your use of the Website, materials, or related Services; or (e) any printing or typographical errors in any materials associated with the Website, materials, or related Services.  In addition, you agree to defend, indemnify, and hold La La Vie affiliates harmless from any claim, suit or demand, including reasonable attorney’s fees, made by a third party, due to or arising out of your utilizing the Website, materials, or related Services, your violation or breach of this Agreement, your violation of any rights of a third party, or any other act or omission by you.

In no event will La La Vie, its Officers, Directors, Members, Managers, Shareholders, Employees, Editors, Agents and Representatives (collectively “Representatives”) be held liable for any damages of any kind, including “without limitation” compensatory, direct, indirect, punitive, or consequential damages, loss of income or data, loss of or damage to property, personal injury, and claims of customers or third parties arising from any customer’s interaction, involvement, and relationship with members of the online and/or offline dating community of any kind, even if La La Vie was advised of the possibility of such damages.  Furthermore, by using the Website, you agree to hold La La Vie harmless from any administrative, criminal, or civil proceedings.

Assignment

Neither you nor La La Vie may assign or transfer any rights, duties, or obligations herein nor any rights, duties or obligations associated with any service purchased through La La Vie without the prior written consent of the other, and any purported attempt to do so shall be null and void.

No Waiver

Waiver of breach or failure to strictly enforce the terms of this Agreement shall not preclude a party from asserting a subsequent or continuing breach or from otherwise requiring strict compliance with the terms of this Agreement.

No Warranties

LA LA VIE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY NATURE, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY REPRESENTATIONS OR WARRANTIES WITH RESPECT TO YOUR DATING SUCCESS.  IN NO EVENT SHALL COMPANY OR ITS REPRESENTATIVES BE LIABLE FOR SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY FAILURE OF ANY PERFORMANCE BY THE COMPANY.

Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this Service or the Agreement must be filed within One (1) Year after such claim or cause of action arose or shall be forever barred.

Entire Agreement

This Agreement constitutes the entire understanding and agreement of the Parties entering into it (“the Parties”) with respect to the subject matter covered in it, and it supersedes all other prior agreements and understandings, written or oral, among the Parties, with respect to such subject matter.

Authority

The Parties hereby warrant that this Agreement is duly executed with full authority and approval of each of them.  The Parties further warrant and represent that they have fully informed themselves of the terms and legal effects of this Agreement, that no promises or representations have been made to induce their execution of this Agreement except those set forth herein, that they have relied on independent judgment and, where applicable, the advice of their legal counsel in executing this Agreement, and that they have full authority and capacity to execute this Agreement and that no further authorization, ratification or approvals from any entity, organization or agency, including any corporate, legal or judicial entity, shall be necessary in order to give this Agreement full force and effect.

Severability

If any provision, or portion thereof, of this Agreement is held invalid, illegal, void, or unenforceable by reason of any law, rule or regulation, administrative order, judicial decision, or public policy, the remaining provisions shall not be affected, impaired or invalidated thereby, and each term and provision of this Agreement shall remain in full force and effect and be valid and enforceable to the fullest extent permitted by law, and shall be deemed separate from such invalid or unenforceable provision. Any invalid, illegal, void or unenforceable provision shall be deemed, without further action on the part of the parties hereto, amended, limited or replaced and enforced to the extent necessary by a court of competent jurisdiction or arbitrator(s) to render such provision, as so amended, limited or replaced, legal, valid and enforceable, with the a provision or part thereof that comes as close as possible to expressing the intention of the stricken provision, it being the intention of the parties that this Agreement and each provision hereof shall be legal, valid and enforceable to the fullest extent permitted by applicable law.

Interpretation, Construction

The language used in this Agreement will be construed in all cases in accordance with ordinary usage and meaning.  The Parties acknowledge that each Party has reviewed this Agreement and that no single party bears sole responsibility for the draftsmanship of this Agreement.  Consequently, no rule of construction to the effect that ambiguities are to be resolved against the drafting Party should be employed in the interpretation of this Agreement.

Governing Law

This Agreement shall be governed by, interpreted and construed, and enforced in accordance with the laws of Japan, without reference to conflicts of laws principles.

Choice of Venue

All disputes shall be resolved by a court of competent jurisdiction in Japan.

Arbitration

Any controversies, claims, or disputes arising out of or relating to this Agreement shall be resolved solely and exclusively by binding arbitration in accordance with the rules for commercial arbitration of the National Consumers Affairs Center of Japan in effect at the time such arbitration is initiated and shall be administered by such organization.  The arbitration shall take place in Japan. The arbitrator shall be required to follow applicable law. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND LA LA VIE ARE EACH WAVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

The decisions and awards rendered by the arbitrator shall be final and binding on the parties, and judgment may be entered thereon in any court having jurisdiction.  The arbitrator may, as part of any award, award to the prevailing party the costs of such arbitration, including an attorney, expert, and witness fees. This agreement to arbitrate shall be specifically enforceable under prevailing arbitration law.  During the continuance of any arbitration proceeding, the parties shall continue to perform their respective obligations under this Agreement.

E-Sign Act

I agree that this Agreement is governed by the Electronic Signatures in Global and National Commerce Act (commonly known as the “E-Sign Act”), 15 U.S.C. 7000, et seq. and may not be denied legal effect, validity, or enforceability solely because it is in electronic form.  Choosing to click the checkbox “I have read and accepted these terms and conditions” in your email — or in the Google Form sent in your email — and working with La La Vie indicates my agreement to be bound by the terms of this Agreement, and I affirmatively adopt making this selection as my signature and the manifestation of my consent to be bound by the terms of this Agreement.

La La Vie・Connecting Point LLCの個人情報の取り扱い方針につきましては、「個人情報の保護について」をご覧ください。

La La Vieの目的は、個人ユーザーにおいてはその婚活活動を助け、一方クライアントにおいては適切なお相手を見つけるための支援を行うことであり、その目的を故意に妨げるいかなる行為も禁止されます。
La La Vie・Connecting Point LLCは、何をもってサイトの使用を妨害する行為であるかを独自に判断する権利を有し、禁止される行為に違反した登録者・メンバーのLa La Vieご紹介サービスを中止する判断を単独で下す権利を有します。
以下は、禁止される行為の例ですが、禁止される行為は以下に限るものではありません。

1. 虚偽の情報を登録する、または提供する行為。
2. 著作権、商標権、プライバシー権、肖像権、名誉、財産、その他知的所有権を侵害する行為。
3. 個人や団体を誹謗中傷する行為。
4. 法令、公序良俗に反する行為、またはその恐れのある行為。
5. 反社会的な行為。
6. La La Vieの運営を妨げ、あるいはLa La Vie・Connecting Point LLCの信用を毀損するような行為、またはその恐れのある行為。
7. La La Vieのサービスを通じて入手した情報を、複製、販売、出版、その他私的利用の範囲を超えて使用する行為。商業目的や不法な目的に使用、または、提供する行為。
8. 正当な権限無く、La La Vieユーザーのシステム認証およびセキュリティの探求、侵害する行為、または試み。
9. La La Vie・Connecting Point LLCのサービス、ホストコンピュータまたはネットワークに過負荷を与える行為やウイルスメールを送信する行為、あるいはシステムを破壊する行為、またはそれらの試み。
10. 正当な権限無く、La La Vieユーザーの非公開データや非公開アカウントにアクセスする行為、または試み。

1. La La Vieが提供する第三者の情報（クライアントのサーチ情報、メンバーが登録した個人情報、データ、広告、グラフィックス、リンクなど）は、それぞれの情報提供者の責任において提供されるものであり、La La Vie・Connecting Point LLCは、それら提供情報の正確さを保証するものではありません。ユーザーはこれを了承し、自己の責任においてLa La Vieを利用するものとします。
2. La La Vie・Connecting Point LLCにより作成された情報は、時により技術的不正確さや誤字、誤植を含むこともあります。また、La La Vieの提供するサービスに不具合やエラー、障害が生じない事を保証するものではありません。
3. La La Vieの提供情報に含まれる別サイトへのリンクは、ユーザーの利便性のために提供されるものであり、それらリンクを含めることによってLa La Vie・Connecting Point LLCがそのサイトの保証を行うことはありません。また、そのサイトとの商業的な関係を意味するものではありません。
4. La La Vieの提供情報に含まれる製品、サービスあるいは会社名には、商標あるいは知的財産権などにより法的に保護されているものがあります。La La Vie・Connecting Point LLCによるこれら商標への言及は、その準拠法により保護されないことを含意するものではありませんし、それら商標の保持者とLa La Vie・Connecting Point LLCの間になんらかの商業的関係があることを含意するものではありません。

1. La La Vie・Connecting Point LLCは、La La Vieへのメンバー登録やLa La Vie利用から生じる一切の損害(精神的苦痛、求職活動の中断、またはその他の金銭的損失を含む一切の不利益)に関して責任を負うものではありません。 また、いかなる状況においても、ご紹介に至らなかったことから派生する損害を含むLa La Vieの利用に起因する、法的措置、過失、契約の履行におけるデータ、利益の損失の結果による直接的または間接的な損害に対して損害賠償を負うものではありません。
2. 次の各号に該当する場合は、第三者による個人情報の取得につき、La La Vie・Connecting Point LLCは何ら責任を負いません。
   ユーザー自らが、La La Vieの機能または別の手段を用いて応募を希望する特定のクライアントに個人情報を明らかにする場合には、La La Vie・Connecting Point LLCはその行為に対して何らの責任を負いません。
   La La Vieを通し自社クライアントあるいは、提携相談所のクライアントに応募した場合は、プロフィール・個人情報のクライアントへの開示を了承したことになります。応募後の個人情報の管理主体はクライアントか提携相談所となり、これらの個人情報の取り扱いについては、La La Vie・Connecting Point LLCは何ら責任を負いません。また、サーチ情報に対してプロフィールを直接送付するなど自ら個人情報を開示した場合も、個人情報の管理主体はクライアントあるいは提携相談所となり、これらの個人情報の取り扱いについては、La La Vie・Connecting Point LLCは何ら責任を負いません。 本人特定情報以外の登録した内容により、期せずして本人が特定できてしまった場合は、La La Vie・Connecting Point LLCはその行為に対して何ら責任を負いません。
3. La La Vieの提供情報からリンクしている第三者サイトへのリンクは、La La Vie・Connecting Point LLCが管理運営するものではなく、その内容の信頼性やサイトの変更、更新などに関して、La La Vie・Connecting Point LLCはいかなる責任も負いません。

La La Vie・Connecting Point LLCは通常講ずるべきウイルス対策では防止できないウイルス被害、天変地異による被害、その他、La La Vie・Connecting Point LLCの責によらない事由による被害が生じた場合には、一切責任を負わないものとします。
La La Vie・Connecting Point LLCはこれらの不可抗力に起因してLa La Vieにおけるデータが消去・変更されないことを保証するものではなく、メンバーや掲載企業などのユーザーは、かかるデータを自己の責任において保存するものとします。

ユーザーが、本規約に違反し、La La Vie・Connecting Point LLCに対し損害を与えた場合、ユーザーは、La La Vie・Connecting Point LLCに対し、直接・間接を問わず、一切の損害賠償義務を負担することとします。

La La Vie・Connecting Point LLCは、事前の予告なく、本規約を随時変更することができるものとし、本ページの改訂により行われます。

ユーザーとLa La Vie・Connecting Point LLCの間で生じた紛争については、米国ハワイ州を第一審の専属合意管轄裁判所とします。

上記紛争の準拠法は、米国法とします
